Lightning Callback ("we", "us", "our") is a sole-proprietorship operating a lead-capture assistant that answers missed calls, texts, and web messages on behalf of local service contractors, and hands the contractor a qualified lead (the "Service"). This Privacy Policy explains what personal information we collect, how we use and share it, how long we keep it, and the choices and rights available to you.
This Policy covers two different groups of people, and our role differs for each:
- Contractors ("Customers") — the businesses that subscribe to the Service. For their
account and billing information, we act as a "controller".
- End Customers ("Leads") — the members of the public who call, text, or message a
contractor and interact with our assistant. For this information, we act as a "service
provider / processor on the contractor's behalf" — the contractor decides why the data
is collected and how it is used. If you are an End Customer and want to exercise rights
over your data, see [Section 9]; in most cases the contractor you
contacted is the appropriate first point of contact.

The Service is offered and used **exclusively in Tennessee, United States.** It is intended
for business use by contractors located and operating in Tennessee.

1. Information we collect
1.1 Information from Contractors (Customers)
- **Account and profile information** you provide to configure the Service: business name,
trade, service area, your business/mobile phone number, a call-forwarding number, greeting
text, and the qualifying questions your assistant asks.
- **Subscription tier:** which plan you are on (Silver, Gold, or Diamond). **Payment is
handled entirely by our website platform, Wix; we do not collect, receive, or store your
payment card or bank details.** Wix informs us only of the plan you have purchased. See
[Section 6](#6-how-we-share-information).
- **Telephony configuration:** the phone number assigned to you through our telephony
provider (Twilio).
1.2 Information about End Customers (Leads)
When a person contacts a contractor through the Service, we collect and store, on the
contractor's behalf:
- **Contact details:** name, phone number, and/or email address.
- **Service address or location** (for example, the address or city/ZIP where work is needed).
- **Details of the inquiry:** the type of job, urgency, preferred timing, and a short summary.
- **The full conversation:** a verbatim transcript of the call-back text exchange or web chat,
including anything the person chooses to type or say. Because this is free text, it may
contain additional personal information the person volunteers.
- **Metadata:** the time of the interaction and the channel (missed-call text-back or web chat).
1.3 Information collected automatically
- **Technical and log data** generated when the Service is used, such as timestamps, request
and error logs from our hosting and infrastructure providers. Our application error logs are
designed to capture technical error details rather than conversation content.
We do **not** intentionally collect Social Security numbers, government IDs, financial account
numbers, precise geolocation from a device, biometric data, or other "sensitive" categories.
Please do not enter such information into the assistant.

2. How the assistant works (automated and AI processing)
The Service uses **automated systems, including third-party artificial-intelligence (AI)
language models, to read incoming messages and generate replies** in a natural, conversational
style. To provide the Service, the contents of the conversation are sent to our AI provider
(Anthropic) and telephony provider (Twilio) as described in [Section 6](#6-how-we-share-information).
The assistant gathers qualifying details and creates a lead for the contractor to follow up on
personally. The Service does **not** make automated decisions that produce legal or similarly
significant effects about any individual.

3. Sources of information
We collect information (a) directly from Contractors when they configure and use the Service;
(b) directly from End Customers when they call, text, or message a contractor; and
(c) automatically from the infrastructure that runs the Service.

4. How we use information
We use personal information to:
- Provide, operate, and maintain the Service — answer missed calls and messages, run the
conversation, and generate and deliver leads to the contractor.
- Send and receive the text messages and calls that make the Service work.
- Set up and manage Contractor accounts, subscriptions, and billing.
- Secure the Service, prevent fraud and abuse, and validate that requests are legitimate.
- Diagnose problems, monitor performance, and improve reliability.
- Comply with law and enforce our agreements.
We use End-Customer (Lead) information **only to provide the Service to the contractor** the
person contacted, and as directed by that contractor — not for our own independent purposes.

5. Legal bases / no use for advertising
We do not use personal information for **targeted advertising**, we do not **sell** personal
information, and we do not engage in **profiling** in furtherance of decisions that produce
legal or similarly significant effects. We do not use Lead data to train our own models, and
we instruct our AI provider through our commercial terms with them (see
[Section 6](#6-how-we-share-information)). [ATTORNEY: confirm the model-training / data-use

6. How we share information
We share personal information only with the following categories of recipients, and only as
needed to run the Service:

We may also disclose information: (a) to comply with law, legal process, or lawful government
requests; (b) to protect the rights, safety, and property of LIGHTNING CALLBACK, our Customers, or
others; and (c) in connection with a merger, acquisition, financing, or sale of assets, in
which case we will require the recipient to honor this Policy. **In every case, we do not sell
personal information and do not disclose it in exchange for money or other valuable
consideration.**
Each service provider above is bound by contract to use the information only to provide
services to us and consistent with this Policy.

7. SMS, calls, and telephony
The Service sends and receives SMS text messages and handles phone calls through Twilio. When
a person's call to a contractor is missed, the Service may send that person a text message to
continue the conversation. **Contractors are responsible for ensuring they have any consent
required to contact their customers by call or text** (see our Terms & Conditions and
[Section 12](#12-notes-specific-to-contractors)). Standard message and data rates may apply.
Recipients can stop messages at any time by replying **STOP**.

8. How long we keep information
- **Lead data** (including transcripts) is retained until the contractor deletes the lead from
their portal, at which point that contractor's copy of the lead — including the person's
name, contact information, address, and full transcript — is **permanently deleted** from our
active database. If the same person contacted more than one contractor, deleting a lead at
one contractor does not affect the separate record held by another.
- Absent deletion by the contractor, Lead data may be retained for as long as the contractor's
account is active.
- **Contractor account and billing data** is retained for the life of the account and for a
reasonable period afterward as needed for legal, tax, accounting, and dispute-resolution
purposes.
- Backups and provider logs may persist for a limited additional period consistent with each
provider's retention practices.

9. Your privacy rights
Tennessee residents may have rights under the **Tennessee Information Protection Act (TIPA)**,
subject to its exceptions and thresholds, including the rights to: confirm whether we process
your personal information and access it; correct inaccuracies; request deletion; obtain a
portable copy; and opt out of the sale of personal information, targeted advertising, or
certain profiling. **We do not sell personal information, serve targeted advertising, or
conduct such profiling, so those opt-outs do not apply to our processing.**
- **Contractors** may exercise these rights over their account data by contacting us at
- **End Customers (Leads):** because we hold your information as a service provider on behalf
of the contractor you contacted, please direct access, correction, and deletion requests to
that contractor in the first instance. You may also contact us at caleb@lightningcallback.com
and we will assist the contractor in fulfilling your request or forward your request to them.
We will verify requests before acting on them and will respond within the time required by
applicable law. You may designate an authorized agent to act on your behalf where the law
permits. We will not discriminate against you for exercising your rights.

10. Security
We use reasonable administrative and technical safeguards designed to protect personal
information, including access-scoped authentication for the portal and provider-level
protections for data in transit and at rest. No method of transmission or storage is
completely secure, and we cannot guarantee absolute security.

11. Children's privacy
The Service is intended for business use and is **not directed to children under 18**. We do
not knowingly collect personal information from children. If you believe a child has provided
information through the Service, contact us at [PRIVACY CONTACT EMAIL] and we will delete it.

12. Notes specific to Contractors
If you are a Contractor, you determine what qualifying questions the assistant asks and how you
use the leads you receive. You are responsible for providing your own customers with any
notices and for obtaining any consents required by law for your collection and use of their
information and for contacting them by phone or text. Our Terms & Conditions and any data
processing terms between us govern this allocation of responsibility.

13. Data location
We store and process information in the United States. The Service is intended for use only in
Tennessee, United States.

14. Changes to this Policy
We may update this Policy from time to time. When we do, we will revise the "Last updated" date
above and, where appropriate, provide additional notice. Your continued use of the Service after
changes take effect constitutes acceptance of the updated Policy.
